Purpose

Purpose of the Job: The Claims Manager provides active support to the project in the claims management activity using his or her expertise, necessary tools, reporting, and guidance in order to prevent potential claims, to defend and / or execute entitlement on behalf of Alstom under the contract agreements in accordance with the Contracts, Claims and Insurance Management Manual (CCIM).

 

Organisational Reporting

Hierarchically and functionally to the Senior Contract Manager.

Key Network & Links

Internal: Contract Managers, Claims specialist, Legal and in-house lawyers, Project management and team members, Sourcing .

External: Other contractors, Consortium partners, law firms, insurance brokers, customers representatives, subcontractors etc.

 Measurement

Timely processing of project claim requests, Extension of Time (EoT), variations, contract amendment and claim files preparation analysis, validation, building, documenting, follow-up and negotiation of claims.

Ensure success of claims and positive key performance indicators

Agreed deliverables to be on time.

Trust Team Action.

Responsibilities

 

 

Scope of the role and responsibilities:

  • To advise and build a Contracts and Claims strategy
  • Forensic claims research, development and compiling (including writing Narrative(s))
  • Develop and produce any project specific process and way of working for claims management
  • Dispute settlement and any other claim management activities required.
  • Timely issuance of notices to the customer or its representative,
  • Advice on specific issues and claims activities
  • Reviewing of claims files from or against the company
  • Preparing claims files (incl. delay analysis and quantum with the support of other team members)
  • Reporting on claims activity to the project and legal and Contract management
  • Provide training on claims to project management and contract management community
  • Ensure application of CCIM and Alstom governance
  • Responsible for maintaining good records and retention of documents in accordance with Alstom policy
  • Anticipate events and risks associated with the claim management activity; propose various counter-strategies and commercial solutions to keep the situation under control.
  • Work closely with the Project Contract Managers on the Riyadh Project to mitigate risks and leverage opportunities
  • Provide at any time, on Management demand, a reliable and understandable contractual and commercial analysis of the project

 

Candidate Requirements

 

Educational Requirements / Knowledge / Experience

  • Legal / Contract Management / Commercial degree or Engineer degree with knowledge gained in contractual matters
  • Min of 10 years’ experience performing Claims management
  • Good knowledge and understanding of the planning tool P6 and delay analysis
  • Advantage for candidates with professional experiences in Middle East / South Africa claims management for civil/construction projects (preferably on railway projects) or engineering projects in Power, oil or gas industry
  • Familiar with international contracts and negotiation of claims
  • Knowledge of the Project, Operations and Legal and Compliance organisation
  • Knowledge of the operations organisations and the support function organisation involved in claims
  • Knowledge of applicable contract law, theories of entitlement, and delay analysis and extensions of time
  • Excellent writing skills and fluent in English
  • Good communication skills
