Project Sourcing Contract Manager

Purpose of the Job

The Project Sourcing Contract Manager is responsible for

  • Identifying all  sourcing contracts (including subcontracts) to be implemented and manage the validation through internal legal network
  • Managing all  sourcing claims  on RIYAHD project,
  • Supporting systematic claim management with Supply Chain and Quality

Mission

Objectives

To support and anime sourcing contractualization processes until start of contract’s execution;

To manage claim management on Riyadh Métro Project  with suppliers, service providers and subcontractors.

Measurement

  • Identify all sourcing contracts needs and re-orientate to the legal counsel in charge of (including subcontract, EPCM, Installation , FIDIC ) (number of contracts and typology)
  • Specific claim recovery target achievement.

Systematic claim recovery target achievement .Ensure that all sourcing related contracts (including subcontracts) and contractual deliverables are processed on time , consistent with the Project requirements, Supplier claim management, and pilot the recovery plan for claim where suppliers are in default and/or breach.

Responsibilities

  • Contractualisation 
  • Animate CSS process (except in case of derogation coming from Region)
    • Animate the task force for the definition of purchasing specific conditions (CSS) for RIYADH METRO  Project by supporting the PRSMs.
    • Ensure that the contractual package (output of the CSS process) is used and properly adapted on participating Unit sites (and other PL / Service, Infra, ADM)
    • Awarness and training session for sourcing teams (including Participating Units) and other identified stakeholders on specificities of the contractual package.
    • Identification of golden rules for negotiation.
    • Support the definition of the best contractualization strategy
  • Support to Top 10 and Go Order animation for RIYADH METRO PROJECT where applicable.
  • Ensure that all sourcing related contracts (including subcontracts) and contractual deliverables are processed on time, consistent with the Project requirements.
  • Ensure proper management of Purchase Order (ex: Transfer Data sheet process definition and deployment, follow-up of A/R, PO validation, …).
  • Support Project Sourcing Manager for the correspondence with Engineer for Supplier’s approbation.
  • Support to LOI and any contract preparation (on request only in relation with the Legal Counsel in charge).
  • Participation to negotiation (on request only in relation with the Legal Counsel in charge).
  • Set up the toolbox for identifying contractualization progress, collection of bonds, complete contract package provided (appendixes including) and duly validated by accountable, respect of date of signature of contracts.

 

Contract execution management:

  • Support the PRSMs and other stakeholders in the management of the Suppliers’ contractual obligations (identification of obligations to be followed, definition of appropriate tools and processes, support the animation).
  • Follow-up and support in implementation of contract and/or PO amendments.
  • Ensure proper management of contract documents is done (definition of appropriate process and support of implementation).
  • Coordinate emission of bonds, bank guaranties and escrow agreements.
  • Notify suppliers and ensure follow up, notably in case of failure of contractual obligation.
  • Anticipate risks, propose counter strategies and contractual & commercial solutions to Project Sourcing Manager to mitigate the degradation costs of the Project.
  • Provide reporting to the MEA Sourcing Contract Manager, the Country Sourcing Manager,  Project Contract  Manager about any events that could have significant impact on the Project.

 

Claim Recovery

  • Identify potential claim, and manage each claim in accordance with Sourcing Claim Management Process.
  • Be the « project manager » for each specific claim of your scope:
    • Organisation of Go/No Go meeting for each claim « Open »
    • Coordinate the construction of the claim file with info/evidence (gathering sourcing, technical, quality, cost, supply chain information).
    • Participate to the definition of the claim strategy, to the negotiation, to the settlement agreement definition, if needed.
    • Push for the progress of claim.
    • Check/advise on the content of claim letters to be sent to the supplier.
    • Make sure the Legal Counsel is asked for support when required.
  • Follow-up the claim portfolio of your scope and ensure its alignment with ASIP data.
  • Communicate on claim portfolio progress (reporting) and escalate when support required.
  • Achieve recovery target (RTBS/Secured) defined with Sourcing Contract Manager MEA and Sourcing Director MEA.

 

Transverse

  • Build a network with Sourcing and Project community.
  • Build a network with Legal Region (Insurance, Project Contract Manager, Claim, legal counsel).
  • Organise Q&A sessions or any other communication on the site of the project (if relevant) in order to train sourcing community and other identified stakeholders on claim and contractualisation basics.

Candidate Requirements

Educational Requirements

  • Master degree.
  • Legal profile (Law degree from a reputable university) or Sourcing profile ( Master or MBA from a reputable university)

Desired Knowledge / Experience

  • Experience in a global company, multicultural and international environment. ( Oil & Gas, Construction, Concession, energy, Civil engineering market)
  • Minimum of 5 to 10 years experience in Project Management or in a factory site.
  • Minimum of 5 years experience in contract management and claims, with suppliers and/or customers
