YOUR MISSION:
- To drive Key Suppliers and Subcontractors Contract Management activities to ensure timely and proper performance of obligations of the Parties, including defending claims and building claims to defend Alstom’s interests, rights, entitlements and remedies by early identification and mitigation of risks with suppliers and subcontractors and ensure proper execution of the Project with profitability. Ensuring value for money and seamless assimilation of Key Supplier development(s), deliveries and support to Projects
RESPONSABILITIES:
- Contribution to and implementation of CMSP from Key/Critical Supplier and Subcontractor/Subcontractor perspective
- Supporting Sourcing and Project teams to ensuring timely notifications with Key/Critical Supplier and Subcontractors
- Measurement of Claim Recovery and Claim avoidance through Contract Management KPIs
- Preserving Alstom’s rights and entitlements as provided in Contracts with suppliers and subcontractors and ensure those parties fulfil their contractual obligations
- Protect Project profitability by proactive Contract management of Key/Critical Supplier and Subcontractor/Subcontractors.
- Ensuring that Alstom mandatory principles and processes relating to supplier facing Contract and Claims Management are communicated to and understood and followed by the Project Teams and Sourcing.
- Providing proactive contractual support to complex and difficult projects where Key/Critical Supplier and Subcontractors are involved
- Provide guidance and support by expertise and Rex on contracting processes for Key/Critical/critical Supplier Contracts
- Constant coordination and collaboration with the PrCM and project team to ensure Project and Key/Critical Supplier and Subcontractor alignment in execution phase
- Proactive management of Claims to recover costs and/or collection of liquidated damages/penalties in case of contractual default
- Identify and monitor risks & opportunities and suggest mitigation or capitalization strategies with Key/Critical Supplier and Subcontractors during the Project execution.
- Coordinate the construction of the defensive and offensive claim file with info/evidence (gathering sourcing, technical, quality, cost, supply chain information, etc.) In particular KSCM is to involve upfront Planning manager for EOT/delay analysis related matters and Financial Manager for costs assessment /evaluation related matters.
- Define the claim strategy with Project Team and Sourcing, lead the negotiation of the claim, draft and obtain required reviews/approvals of the settlement agreement or change order
- Proactively drive the progress of claim to closure
- Ensure claim letters to be sent to the supplier contain the appropriate content and are reviewed/approved for accuracy and legal sufficiency
- Act as the coordinator for the Legal representative when required
- Accomplish required claim reporting in an accurate and timely manner in Contract Management KPI
- Available to travel 50% of the time
DESIRED PROFILE:
- A degree in Law, Engineering, Finance, Technical, Purchasing / Sourcing, Economics or business sciences
- Knowledge/Understanding of Contract Management and Commercial Law
- Knowledge of Supplier Contract Management/Subcontract Management
- Sourcing/Procurement experience, contract management experience ideally with Suppliers and Subcontractors
- Strong experience incomplex projects and project structures
- More than 5 years experience
- Legal/ technical background
- Ability to understand financial reports and develop Contract Administration/Action strategies derived from them
- Ability to comprehend and assess viability, compliance with and/or requirements of technical requirements
- Relationship Building and Team Work spirit
- Pro-active Management Style
- Advanced written and Oral Communication skills
- Computer skills and broad understanding of various types of computer applications/uses (ie, POS systems, Inventory Systems, Data Bases, etc.)
